Child support is an issue that is the subject of debate between many parents. Some parents believe they are paying too much, while the other side believes they are receiving too little support. Modification and enforcement of child support orders

Enforcement and modification can take place any time after a temporary court order, property settlement agreement, or the divorce judgment is executed. Enforcement can also take place for children born out of a relationship, which was not a formalized as a marriage. Enforcement is the effort to make sure that child support arrearage payments are made. Courts are generally willing to take strong measures in enforcing child support payments, including invading asset accounts, or issuing bench warrants. Enforcement can also take place long after the child has reached age 18. The statute of limitations can be an effective defense to enforcement claims made years after the child has reached age 18.Modification is the process used to effect a change in child support payments. If the circumstances of either party have substantially changed, such as emancipation (usually reaching age 18) or a considerable increase or decrease in income, a petition for modification of the child support order may be appropriate.
